Accuracy Of Content
We have taken care in the preparation of the content of this website, in particular to ensure that price s quoted are correct at the time of publishing and that all goods have been described accurately. However, orders will only be processed if there are no material errors in the description of the goods or their prices as advertised on this website. Any weights, dimensions or capacities given which relate to the goods are approximate only.
Damage To Your Computer
We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website and that virus protection is up to date. Except in the case of negligence on our part, we will not be liable to any person for any loss of or damage to computer or communications equipment which may arise as a result of using this website.
Privacy
Cabins Unlimited do not share or sell any information provided to us either online or in person with third parties, excluding with the relevant delivery company to fulfil your purchase requirements. The information provided to us is solely used to process your quote and/or order. No payment details are retained by us once payment has been approved.
Making An Online Purchase
Upon checkout you will be asked to confirm your order. If you wish to make changes at this stage and are unable to do so please contact us on one of the above numbers. Terms and Conditions must be accepted before you can proceed to payment. Confirmation of your order will be sent to you via email to the email address provided. We will send you a Site Survey Form when your order is processed so that you can provide us with information about the site prior to delivery and/or installation of your building. You will need to complete this and return it to us before your order can be dispatched.
Payment Terms
When purchasing from Cabins Unlimited full payment for the building is required at the time of ordering, whilst any remaining balance (e.g. for base materials, accessories, installation services etc.) must be paid in full a minimum of 14 days before your order is delivered unless specifically agreed in writing by us. Where your order is for an in-stock building and we have agreed a fast delivery time with you, payment must be made in full at the time of order.
We accept most methods of payment including online banking transfer (details upon request), debit cards, and credit cards. All payments are made in GBP (£). Please note we do not accept AMEX/DINERS. All payments are subject to successful validation checks and authorisation by the card issuer. If payment from the card issuer is refused, we reserve the right to cancel or postpone the order. If this is the case we will not be held liable for any delay or non-delivery.
All items remain the property of Cabins Unlimited until payment has been made in full. If you believe you may experience difficulty in settling your invoice in full, please contact us at the earliest opportunity to discuss this. We reserve the right to take any necessary steps to recover unpaid balances, with any interest charged daily at 2% above the Bank of England base rate. Any administration charges, legal fees or recovery costs incurred as a result of late payment will be sought in addition to the final balance owed.
If you fail to settle your account with us prior to the agreed date, we reserve the right to postpone your delivery and to hold your goods at our storage facility until the balance is paid in full.
Finance Agreements
From time to time we may provide access to finance options. When purchasing goods using a finance option you will be entering into a direct agreement with the finance company and not Cabins Unlimited. We process the finance agreement based on information provided to us by you. If it is suspected information has been provided incorrectly or fraudulently, we reserve the right to cancel the transaction at any stage and make the relevant financing company aware. When entering into any finance agreement, responsibility lies with the person named on the credit application to ensure they can comfortably meet the repayment requirements.
Cabins Unlimited does not offer financial advice and acts solely upon the direction and guidance of the financing companies we work with.
Acknowledging An Order
To enable us to process your order, you will need to provide us with your e-mail address. We will notify you by email as soon as possible to confirm receipt of your order and to confirm details. For the avoidance of doubt, this correspondence does not constitute a contract between us.
Accepting An Order
Cabins Unlimited may refuse to accept an order under any circumstances which may include, but are not limited to:
- Where goods are not available.
- Where we cannot obtain authorisation for payment
- If there has been a pricing or product description error
- If we cannot make sufficient contact with the person placing the order
- If you do not meet any eligibility criteria set out in our Terms & Conditions
If cancellation of an order does take place, Cabins Unlimited will make you aware at the earliest available time.
Warranties
Cabins Unlimited products carry a standard warranty direct from the individual manufacturer. This is usually three years for the building and one year for windows and doors, but may vary with each manufacturer. Full details can be found on our website.
In all instances, Cabins Unlimited will refer back to the manufacturers warranty.
All buildings must be treated, regardless of pre-treatment, within the first 2/3 weeks of being installed/constructed with a timber treatment containing a colour pigment to protect against UV damage on the exterior and treated with a good quality timber treatment on the interior. If this is not done it will invalidate your warranty.
Site Surveys for Purchases and Installs
All purchases of timber buildings require a basic site survey to be completed. This is primarily to provide the delivery company with accurate information regarding access requirements. Incorrect or incomplete site survey forms may result in your order being cancelled or delayed. Site surveys can be completed by the customer with the aim of ensuring that delivery runs as smoothly as possible, adding no additional charges for the customer if specialised delivery methods are required.
Where an incomplete/inaccurate site survey form has been submitted, Cabins Unlimited reserve the right to review any charges and in extreme circumstances cancel an order with a charge of £300. Where our professional installation service has also been purchased a more detailed site survey form will need to be completed, either by the customer or by a member of Cabins Unlimited staff if we have visited your property. Full details on how to complete a site survey are laid out in the site survey form.
Changes to the design, windows or hardware
On very rare occasions, the manufacturer may change their design slightly or alter the way the windows open or change the hardware they supply with the cabin. This may happen without our knowledge and so the cabins supplied will be that currently being supplied by the manufacturer and will not constitute a claim against Cabins Unlimited. These slight changes may mean that the model delivered may be slightly different than those shown on the website or display sites if older models are being displayed and will not constitute a material change to the purchased product.
Delivery
Our timber building products are, in the main, made to order. Products such as sheds, garages, log cabins and summerhouses will have a standard lead time. The lead time will be discussed with you at the time of placing your order, if it is not advertised on the product listing on the website. Where a specific date is required please make us aware in good time so we can confirm this date is achievable with the manufacturer and the delivery company. If there are any delays, Cabins Unlimited will make you aware soon as possible.
As standard, we deliver to customers in the UK mainland. We deliver free of charge to locations in England and Wales, and will quote on a case-by-case basis for delivery to Scotland. We do not deliver to offshore locations. Locations such as Northern Ireland, the Channel Islands, Isle of Man, Orkney, Shetland and Scottish Islands will be purely on request and after individual discussion and written confirmation from Cabins Unlimited. Any additional charges outside of the above will be the responsibility of the customer.
Standard delivery practice will mean your order is delivered to the address selected at time of ordering and usually placed at the front of the property, for example, your driveway. The courier company will contact you on the number provided to inform you of a delivery date. If the date is not available they usually offer alternative dates. If a later delivery date is selected by yourself Cabins Unlimited cannot be held liable for additional delays.
Cabins Unlimited shall be under no liability whatsoever for any delay or failure to deliver the products within our estimated timescales. Factors that can affect delivery times can include but are not limited to:
- An unprecedented peak in seasonal sales
- Manufacturer delays
- Factory opening times including national holidays and shutdowns
- Delivery company workload
- Vehicle breakdowns
- Staffing
Delivery of materials can be made in the week leading up to your install, please make our team aware if this isn’t possible. Cabins Unlimited will not be held liable for any deliveries that are turned away at the customer’s request. If materials have been turned away, we reserve the right to reschedule the install and charge a return fee of £200 + VAT.
NOTE: Please ALWAYS let us know when you have been contacted with a delivery date for your cabin. Some materials will come separately to the cabin and these need to be arranged once a delivery date has been confirmed to you, Please call us on 01362 470075 to let us know.
Risk And Ownership
Risk of damage to or loss of the goods passes to you at the time of delivery to you. If you choose to use your own courier then the risk passes to you as soon as the goods are handed to your courier. You will become the owner of the goods once they have been delivered to you.
Installation Service
Cabins Unlimited offer an installation service that is usually booked at the time of ordering, however this can be added on at a later date. Should you wish for us to quote for this please contact us on the above number quoting your invoice number. Whilst our installers are skilled at what they do, they are not qualified carpenters. They will aim to fit your cabin to the required specification but will not be held accountable should you request changes to the cabin from what was originally ordered. It is assumed by Cabins Unlimited that where work will involve access to a neighbouring property/garden the customer will seek the relevant permissions prior to the install date. If access to your property or a neighbouring property is not granted, this may delay the install and you may incur a ‘return to job fee’ based on the cost to us to reschedule the job. An install date will be booked through the operations department, if this has to be rescheduled due to unforeseen circumstances Cabins Unlimited will notify you at the soonest point possible. Any outstanding monies must be paid prior to delivery or fitting and full payment must be received 14 days before the agreed delivery or fitting date, unless otherwise agreed in writing by us.
Cabins Unlimited will not be liable for any economic losses or claims including, but not limited to loss of revenues, data, profits, expenses, contracts, business or anticipated savings; or loss of goodwill or reputation; or special or indirect losses due to any fitters and contractors not being able to continue installation as a result of missing, damaged, non-delivery or incomplete delivery of goods ordered from Cabins Unlimited. Where you use a third-party installer, the contract is between you and the installer. With installation prices quoted it is assumed that access to the install site is unobstructed and bears no health and safety risks to our installers and is subject to a completed site survey. Our installation teams will aim to be as respectful to the grass/garden however in some cases damaged turf is inevitable during bad weather. If you wish for us to bring along disposable boards, please let your sales representative know to quote for this at an additional charge. Where buildings do not have a floor, it is the customer’s responsibility to apply silicone to the base of the walls/posts to ensure it is water tight. In addition, if a customer is painting their own cabin we recommend that good quality treatment is applied to both the inside and outside of the building and also an over paintable hybrid silicone bead be applied to all external interlocking log ear joints.
Waste Disposal
Please note waste from the install of your timber building (wrapping, wood, pallets, etc) cannot be taken away by the install team unless arranged at the point of ordering. If you would like for us to remove waste, this would be charged at £96 (for local installs only). The price quoted is for the rubbish and waste from the actual cabin or timber building. Any green waste, fencing, old sheds or wood or earth/rubble would need to be quoted separately for disposal and removal and are not included unless stated. Please discuss with our team the options available.
Base Work
In the event of a base already being in place or installed by a third-party, Cabins Unlimited reserve the right to cancel or put on hold an install if that base work is deemed unlevel or sub-standard. You will be advised of the next steps available to you and any additional costs. If the install goes ahead as per the customer’s request Cabin Unlimited will not be held liable for any movement issues that arise from buildings on a substandard base.
Materials
The nature of the products we supply means they can be affected by the environment, unlike plastic, steel or other man-made products. As timber is a natural product it will have grains and knots which will vary, these variations can absorb timber treatments and react to the atmosphere differently. Some splitting of the timber may occur as it expands and contracts with changes in humidity and temperature. Any extreme changes in climate may cause knots to fall out, this is perfectly natural and in no way undermines the integrity of the building. Timber logs may also have some twisting and warping. Fitting any twisted logs requires the use of a clamp and long 200mm screws to pull the log into shape. This is not classed as a product defect or damage unless it makes the building unfit for purpose.
Doors and Windows
In some instances, door and window adjustments may need to be made by yourself over the life of your timber building. Please note this is part of owning a building that is made from a natural product. Adjustments to doors and windows are not classified as a fault or defect and will not be classed as repair needed to the building. Cabins Unlimited are happy to advise our customers on how to make these adjustments themselves. A fee may be incurred if we are called out by the customer to rectify a suspected fault which is actually a straightforward adjustment that could have been completed by the customer.
We offer an optional support service for the unlimited adjustment of doors and windows during the lifetime of your building, for customers in Norfolk, Suffolk, Essex and Cambridgeshire only. Please speak to your Sales Advisor to discuss this further.
Glass
If there are any breakages to the glass in your order, please take photos and send them to operations@cabinsunlimited.co.uk at the soonest point in time. Cabins Unlimited will not accept any claims for glass breakage during transit if more than 7 days have passed from the delivery date, to you informing us of the breakage. Once the timber building is installed we will not be held liable for any glass breakages due to fixings made to the windows or doors e.g. blinds, curtain poles.
Claims and Damaged Goods
On very rare occasions our goods can receive some light damage during shipping. We will always work with our customers to resolve any issues you might have with your
order. You must inform us of any breakages or damages to the product received from us within 7 working days of delivery. Please quote your invoice number in all correspondence.
Our standard resolution process is:
- To make good any shortage or non-delivery
- To replace or repair any goods that are damaged or defective
- To refund to you the amount paid by you for the goods in question, at our discretion
Risk of loss or damage of any products passes to you on the date when the products are delivered to you or on the date of our first attempted delivery to your delivery address. Replacement parts are sent direct from the manufacturer, you will be advised of lead times at the time of contacting us to make us aware of the issues.
Returns Policy
If your goods are incorrect, faulty or damaged on delivery you must notify Cabins Unlimited, in writing within 7 days of receiving your delivery. The first stage of rectifying this is noted above under ‘Claims and Damaged Goods’. When a product is returned we will consider the overall condition and reserve the right to seek payment for any damage incurred by yourself or poor re-packaging that may affect the re sale value of the returned item. Goods must be returned within 28 days of delivery. Collection will be arranged via our nominated delivery company.
In all instances you must take reasonable care of the item(s) and must not use them. If the item being returned is not defective the customer will incur the return fees. You have a statutory 14 days cooling off period (excluding bespoke orders) from the day you place your order.
Faults/Missing Parts
In the rare instance you should experience a fault or be missing a part please make Cabins Unlimited aware at the earliest opportunity. Standard procedure is for us to contact the manufacturer for a resolution. It is important you check you have received all the components of your order as soon as possible after delivery. The manufacturers will send out any missing/replacement parts directly from the factory and limit it to one case per customer on missing items. We will always work with customers for a positive resolution and keep in contact with you throughout. Should we receive no response to our correspondence four weeks from the last contact date, we will assume a resolution has been made and close the case and therefore any claim.
Cancellation of an Order
Under The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134 you have the legal right to cancel your website order up to 14 calendar days after the day on which you receive your goods (with the exception of any items which have been Made to Order or Customised to your specification). You do not need to give us any reason for cancelling your contract, nor will you have to pay any penalty.
Should you wish to cancel your order, you must notify us in writing, by e-mail to Operations@cabinsunlimited.co.uk Please include full contact details and your Order Reference in all correspondence.
You cannot cancel your contract if the goods you have ordered are bespoke (i.e. made to order), or if you have altered a standard model of timber building in any way.
If you have received the goods before you cancel your contract then you must return the goods to our depot at your own cost and your own risk. If you cancel the contract but we have already processed the goods for delivery, you should not unpack the goods when they are received by you, and you must send the goods back to us at your own cost and risk as soon as possible.
Once you have notified us that you are cancelling your contract and we have received your returned goods, we will refund any sum debited by us from your credit or debit card within 14 calendar days.
We may make a deduction from your refund for any loss in the value of the goods supplied if the loss is the result of unnecessary handling by you (for example installing or using the goods prior to order cancellation).
Reimbursement
Any reimbursements offered are without prejudice and at the discretion of Cabins Unlimited. A reimbursement is only offered on the basis of a good will gesture and is not an admission of liability.
Liability
Unless agreed otherwise, if you do not receive the goods ordered by you within 30 days of the agreed delivery date and you decide to cancel the order rather than re-arrange delivery, we will provide you with a full refund.
We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions. We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or due to events beyond our reasonable control.
Furthermore, we do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.
Timber is a natural product and your timber building will require treatment with a suitable preservative.
You must observe and comply with all applicable regulations and legislation, including obtaining all necessary permissions to purchase, install and, if applicable, trade from, timber buildings purchased from our site. We make no representation and accept no liability for your use of any of our products.
Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Planning Permission and Building Regulations
Cabins Unlimited do not offer advice on planning or building regulations. It is the sole responsibility of the customer to ensure the building and materials you purchase from us meet any, and all, restrictions enforced by your local planning authority. Measurements quoted on our website and in any literature are assumed correct at time of printing and provided to Cabins Unlimited by our chosen manufacturers. Where it is stipulated buildings are under 2.5m in height this applies to timber buildings only and not any materials extending the height. Cabins Unlimited will not be held liable for any discrepancies from manufacturer design/print error. Our log cabins are supplied with no specific usage and therefore we ask that you as the customer seek any advice professionally if you are uncertain on regulations.
Notices
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing. Notices from us to you will be displayed on our website from time to time.
Changes To Legal Notices
We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.
Law, Jurisdiction and Language
This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English Law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
Invalidity
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.
Privacy
You acknowledge and agree to be bound by the terms of our privacy policy.
Third Party Rights
Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
